# Terms of Service

## 1\. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "User") and Sardorbek Rakhimov ("we", "us", or "our"), an individual doing business in Uzbekistan, concerning your access to and use of the Coach Journal mobile application ("App" or "Services").

By downloading, installing, or using Coach Journal, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the App.

We may update these Terms from time to time. When we make material changes, we will notify you by updating the "Last Updated" date and providing notice through the App. Your continued use after changes means you accept the new Terms.

## 2\. Description of Service

Coach Journal is a management application designed for coaches, trainers, mentors, and professionals to manage their clients, athletes, or students. The App provides tools for:

-   Client/athlete profile management
-   Session scheduling and tracking
-   Subscription and payment management through App Store/Play Store
-   Progress tracking and analytics
-   Data export and reporting features

**Important:** Coach Journal is a management tool only. We do not provide coaching advice, training programs, or professional guidance. All coaching content and advice are the sole responsibility of the coach using the App.

## 3\. User Eligibility and Registration

### 3.1 Age Requirements

You must be at least 18 years old to use Coach Journal as a coach or professional. By using the App, you represent and warrant that you are at least 18 years of age.

### 3.2 Account Registration

To use Coach Journal, you must:

-   Provide accurate and complete registration information
-   Maintain the security of your account credentials
-   Notify us immediately of any unauthorized access
-   Be responsible for all activities under your account
-   Not share your account with others

### 3.3 Age Verification

We reserve the right to request proof of age at any time. If we determine you are under 18, we will terminate your account immediately.

## 4\. Subscription and Payments

### 4.1 Payment Processing

All payments for Coach Journal subscriptions are processed exclusively through:

-   **Apple App Store** for iOS users
-   **Google Play Store** for Android users

We do not directly process any payment information. All payment security and processing are handled by Apple or Google according to their respective policies.

### 4.2 Subscription Terms

Coach Journal offers various subscription plans with different features and limits. By purchasing a subscription:

-   Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
-   Your account will be charged for renewal within 24 hours prior to the end of the current period
-   You can manage and cancel subscriptions through your App Store or Play Store account settings
-   Prices may vary by region and are displayed in your local currency

### 4.2.1 Auto-Renewal Disclosure

**IMPORTANT - AUTO-RENEWAL TERMS:**

-   Payment will be charged to your App Store or Play Store account at confirmation of purchase
-   Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period
-   Your account will be charged for renewal within 24 hours prior to the end of the current period
-   You can manage and cancel your subscriptions by going to your account settings on the App Store or Play Store after purchase
-   Any unused portion of a free trial period will be forfeited when you purchase a subscription

### 4.3 Free Trials

If we offer a free trial:

-   The free trial will automatically convert to a paid subscription unless cancelled before the trial ends
-   You will be notified before the trial ends
-   Free trial availability may vary and is subject to eligibility

### 4.4 Refunds

Refund requests are handled according to Apple App Store or Google Play Store policies. Please contact the respective store support for refund requests. We cannot process refunds directly.

### 4.5 Price Changes

We may change subscription prices from time to time. Price changes will be communicated through App Store or Play Store mechanisms and will not affect your current subscription period.

### 4.6 Refunds Upon Account Termination

If we terminate your account for violation of these Terms, no refund will be provided for any unused subscription time. If we discontinue the Service entirely, you may be entitled to a prorated refund for unused subscription time, processed through the original payment platform (App Store or Play Store).

## 5\. Coach-Specific Terms

### 5.1 Independent Status

Coaches using Coach Journal are independent users and not our employees, contractors, or agents. We do not control or direct coaching activities, methods, or advice.

### 5.2 Coach Responsibilities

As a coach using the App, you are solely responsible for:

-   All coaching advice, training programs, and guidance you provide
-   Obtaining appropriate certifications, licenses, or qualifications required in your jurisdiction
-   Maintaining professional liability insurance as needed
-   Ensuring the safety and appropriateness of training programs
-   Obtaining proper medical clearances from clients when necessary
-   Compliance with all applicable laws and regulations in your field

### 5.3 Minor Athletes

If you work with athletes or clients under 18 years of age:

-   You must obtain verifiable parental or guardian consent before collecting any information about minors
-   You are responsible for complying with all laws regarding minors, including child protection laws
-   You must ensure parents/guardians have access to their minor's information
-   You must delete minor's data within 30 days of receiving a valid parent/guardian request

### 5.4 Health and Safety Disclaimer

**Coach Journal does not provide medical, health, or fitness advice.**You acknowledge that:

-   We are not responsible for any injuries or health issues arising from coaching activities
-   You should advise clients to consult healthcare providers before starting any training program
-   You are solely liable for the safety and appropriateness of your coaching

## 6\. User Content and Data

### 6.1 Your Content

You retain all rights to content you create in the App, including client profiles, training plans, notes, and other materials ("Your Content"). By using the App, you grant us a limited license to process and display Your Content solely to provide the Services.

### 6.2 Data Accuracy

You are responsible for the accuracy of all data you enter into the App. We are not responsible for errors or issues arising from inaccurate data.

### 6.3 Data Portability

We provide export features to allow you to download Your Content. You are responsible for regularly backing up your data.

### 6.4 Data Storage

Your data is stored on Supabase infrastructure located in the US East (Ohio) region. By using the App, you consent to your data being stored in the United States.

## 7\. Prohibited Activities

You agree not to:

-   Use the App for any illegal or unauthorized purpose
-   Violate any laws in your jurisdiction
-   Harass, abuse, or harm other users
-   Submit false or misleading information
-   Share inappropriate content involving minors
-   Attempt to gain unauthorized access to the App or its systems
-   Use the App to transmit viruses or malicious code
-   Interfere with or disrupt the App's services
-   Reverse engineer or attempt to extract the source code
-   Use the App for any competitive or commercial purpose without our permission
-   Impersonate another person or entity
-   Sell or transfer your account to others

## 8\. Intellectual Property

### 8.1 Our Property

Coach Journal, including all content, features, and functionality (excluding Your Content), is owned by Sardorbek Rakhimov and is protected by international copyright, trademark, and other intellectual property laws.

### 8.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to use the App for its intended purpose, subject to these Terms.

### 8.3 Copyright Infringement (DMCA)

If you believe content in the App infringes your copyright, please contact us with:

-   Description of the copyrighted work
-   Location of the infringing material
-   Your contact information
-   A statement of good faith belief
-   A statement of accuracy under penalty of perjury
-   Your physical or electronic signature

## 9\. Privacy

Your use of Coach Journal is governed by our Privacy Policy. By using the App, you consent to our collection and use of information as described in the Privacy Policy.

You must comply with applicable data protection laws when collecting and processing client data, including obtaining necessary consents.

## 10\. Third-Party Services

The App may contain links to third-party websites or services. We are not responsible for the content, privacy policies, or practices of third-party services. Your use of third-party services is at your own risk.

## 11\. Disclaimers

**The App is provided "AS IS" and "AS AVAILABLE"** without warranties of any kind, either express or implied, including but not limited to:

-   Warranties of merchantability or fitness for a particular purpose
-   That the App will be uninterrupted or error-free
-   That defects will be corrected
-   That the App is free of viruses or harmful components

**Medical/Health Disclaimer:** The App does not provide medical advice. Always consult qualified healthcare providers for medical concerns.

**Professional Advice Disclaimer:** We do not endorse or verify the qualifications, methods, or advice of any coach using the App.

**COACH VERIFICATION DISCLAIMER:**

Coach Journal does NOT perform background checks, criminal screening, credential verification, license validation, or any other vetting of coaches who use this application. Users must independently verify the qualifications, certifications, and suitability of any coach. You interact with coaches at your own risk.

## 12\. Limitation of Liability

**To the maximum extent permitted by law, we shall not be liable for:**

-   Any indirect, incidental, special, consequential, or punitive damages
-   Loss of profits, data, use, goodwill, or other intangible losses
-   Any damages resulting from coaching activities or advice
-   Injuries or health issues arising from training programs
-   Actions or omissions of coaches or other users
-   Unauthorized access to or alteration of your data
-   Any third-party conduct or content

Our total liability shall not exceed the amount you paid us in the past twelve months.

## 13\. Indemnification

You agree to indemnify, defend, and hold harmless Sardorbek Rakhimov from any claims, liabilities, damages, losses, and expenses, including legal fees, arising from:

-   Your use of the App
-   Your violation of these Terms
-   Your violation of any rights of another party
-   Your coaching activities and advice
-   Any injuries or damages resulting from your coaching
-   Your handling of minor athlete data
-   Your Content or other information you provide

## 14\. Dispute Resolution

### 14.1 Governing Law

These Terms are governed by the laws of Uzbekistan, without regard to conflict of law principles.

### 14.2 Arbitration Agreement

Any dispute arising from these Terms or your use of the App shall be resolved through binding arbitration conducted in Tashkent, Uzbekistan, by a single arbitrator, in English or Russian language. The arbitration shall be administered in accordance with the commercial arbitration procedures of the Republic of Uzbekistan, except where prohibited by law.

**Consumer Protection Exception:** If you are a consumer in the European Economic Area, United Kingdom, or any other jurisdiction where mandatory consumer protection laws apply, this arbitration agreement shall not deprive you of any rights you have under such laws. In such cases, disputes may be brought before the competent courts of your country of residence.

### 14.3 Class Action Waiver

To the extent permitted by applicable law, you agree to resolve disputes with us on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.

### 14.4 Venue

If arbitration is not permitted by law, any legal action shall be brought exclusively in the courts of Uzbekistan, and you consent to the jurisdiction of such courts.

## 15\. Term and Termination

### 15.1 Term

These Terms remain in effect while you use the App.

### 15.2 Termination by You

You may stop using the App at any time. To cancel your subscription, use the App Store or Play Store subscription management.

### 15.3 Termination by Us

We may terminate or suspend your account immediately if:

-   You violate these Terms
-   We are required to by law
-   We discontinue the App
-   Your conduct may harm us or other users

### 15.4 Effect of Termination

Upon termination:

-   Your right to use the App ceases immediately
-   You will have a reasonable period following notice to export your data using the App's export features
-   After this period, we will delete your account data in accordance with our Privacy Policy
-   We do not store payment card details or transaction records; these are maintained by Apple, Google, or RevenueCat according to their respective policies
-   Certain information may be retained as required by applicable law or for legitimate business purposes
-   You remain liable for any outstanding obligations
-   Sections that by nature should survive termination will remain in effect

## 16\. Modifications to Service

We reserve the right to modify, suspend, or discontinue the App at any time without notice. We are not liable to you or any third party for any modification, suspension, or discontinuance.

## 17\. Export Control

The App may be subject to export control laws. You agree to comply with all applicable export and import laws and regulations.

## 18\. Accessibility

We strive to make Coach Journal accessible to all users. If you encounter accessibility issues, please contact us so we can improve the App.

## 19\. California Users

If you are a California resident, you have specific rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA), including:

-   The right to know what personal information we collect, use, and share
-   The right to delete your personal information
-   The right to opt-out of the sale or sharing of your personal information (note: we do not sell personal information)
-   The right to non-discrimination for exercising your privacy rights

## 20\. Electronic Communications

By using the App, you consent to receive electronic communications from us. These communications may include notices about your account, updates to Terms, and other information. You agree that electronic communications satisfy any legal requirement for written communication.

## 21\. Severability

If any provision of these Terms is found invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force.

## 22\. Apple App Store Terms

If you download or use Coach Journal through the Apple App Store, the following additional terms apply:

### 22.1 Apple EULA

Your use of the App is also subject to our End User License Agreement (EULA), available at [coachjournal.app/eula](/eula), which contains Apple-specific terms required by Apple Inc.

### 22.2 Third-Party Beneficiary

You acknowledge and agree that Apple, Inc. and its subsidiaries are third-party beneficiaries of these Terms and our EULA. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

### 22.3 Apple's Responsibilities

Apple has no obligation whatsoever to:

-   Furnish any maintenance or support services with respect to the App
-   Address any claims relating to the App or your use of the App
-   Investigate or defend any intellectual property infringement claims

All such responsibilities rest solely with Sardorbek Rakhimov.

### 22.4 Apple Data Sharing Consent

By using Coach Journal and making in-app purchases through the App Store, you consent to the collection and sharing of your consumption data with Apple Inc. for refund prevention purposes. This consent is detailed in our Privacy Policy, Section 8 (Apple App Store Integration and Data Sharing), available at [coachjournal.app/privacy](/privacy#appleintegration).

## 23\. Google Play Store Terms

If you download or use Coach Journal through the Google Play Store, the following additional terms apply:

### 23.1 Google Play Terms

Your use of the App is subject to the Google Play Terms of Service available at [play.google.com/about/play-terms](https://play.google.com/about/play-terms/). In the event of any conflict between these Terms and the Google Play Terms of Service, the Google Play Terms of Service shall prevail with respect to your use of the Google Play Store.

### 23.2 Google's Responsibilities

Google LLC and its subsidiaries have no obligation whatsoever to:

-   Furnish any maintenance or support services with respect to the App
-   Address any claims relating to the App or your use of the App
-   Investigate or defend any intellectual property infringement claims

### 23.3 Google Play Refunds

Refund requests for purchases made through Google Play are subject to Google's refund policies. Please contact Google Play Support for refund requests.

## 24\. Force Majeure

Neither party shall be liable for any failure or delay in performing their obligations under these Terms where such failure or delay results from any cause that is beyond the reasonable control of that party ("Force Majeure Event").

Force Majeure Events include, but are not limited to:

-   Acts of God, natural disasters, earthquakes, floods, or severe weather
-   War, terrorism, civil unrest, or government actions
-   Epidemics, pandemics, or public health emergencies
-   Internet or telecommunications failures beyond our control
-   Third-party service outages (including App Store, Play Store, or cloud providers)
-   Power outages or infrastructure failures
-   Legal or regulatory restrictions

During a Force Majeure Event, our obligations under these Terms will be suspended for the duration of the event. We will make reasonable efforts to resume normal service as soon as practicable after the event concludes.

## 25\. Entire Agreement

These Terms, together with our Privacy Policy and EULA, constitute the entire agreement between you and us regarding Coach Journal and supersede any prior agreements.
